Truck drivers across the country have been called on by Chapter 61 ministries to be the eyes and ears for the human trafficking crisis in America.  The partnership between the Transport for Christ and Chapter 61 organizations, the Truckers Against Trafficking, along with  many others, have led to a much greater awareness of this problem, not only in the United States but abroad.  Recent headline news is focusing on this $32 billion a year business, which destroys countless lives and enslaves its victims . . . the majority of whom are women and children:

These are just a few of the most recent cases involving human trafficking.  Most Americans are aware of the problem in Asia and Africa, but are oblivious to that fact that it is big business here in the United States.   Chapter 61 ministries will be presenting another set of online informational webinars in September, 2010.

All webinars will begin at 9 p.m. EDT.  Because members of the trucking and travel plaza industry represent the eyes and ears of America on those highways, they can play a critical part in fighting this crime and those who perpetrate it. They simply need to know what to look for, what questions to ask and what steps to take.

Yesterday June 28, 2010 marked a day in history for the National call-in day to support Jason’s Law and the need for more safe and adequate truck parking.  People from all over the country were calling their  Senators and Representatives in Washington, DC, urging them to support HR 2156 and to co-sponsor the bill.

The designated day to call Washington was designed to move the  bill HR 2156 out of committee and passed into law. This much needed bill would begin a targeted pilot program which would address the lack of safe long term truck parking facilities which continues to compromise highway safety within the United States.  Lack of parking has been a major complaint for truckers for many years, and now with a sluggish economy, many more parking facilities are closing down, increasing the need for more government awareness and concern for the problem.

What many do not realize is that the lack of truck parking facilities poses an extreme danger to the general public as well as professional truck drivers.  The problem with inadequate truck parking effects everyone driving the highways:

1  Drivers are allowed to drive just so many hours per day ( Hours of Service Regulations set by Federal Government) Knowing this, a driver must plan their trip accordingly in order to satisfy the law, not exceeding their driving limits.  Note that this is strictly enforced and a driver who violates HOS receives a citation. With the new laws of CSA 2010, these violations can prove to be even more damaging, to both the driver and the carrier, as all violations will be recorded and maintained in a database for safety evaluations.  If a driver can not find parking to rest, he/she not only risks receiving a violation, but more importantly risks the lives of those sharing the highways with them.

2  A truck drivers job is demanding, and the lack of rest can cause serious ramifications in regards to highway safety. If a driver plans his/her trip and there is no adequate parking available in either the rest area or truck stop, he/she is forced to move on, many times driving extremely fatigued.
How ironic, that in a year when the FMCSA is calling for the demand of improved highway safety by implementing CSA 2010, and the new call for Sleep Apnea testing to ensure that drivers are not driving tired due to insufficient quality sleep,  a law which would improve highway safety by creating truck parking and ensuring truckers adequate rest, is not already placed as a priority within the scheme of “safety.”
The fact that truck drivers many times are forced to drive fatigued because of a lack of parking is ludicrous and not at all in alignment with the Federal government Campaign for highway safety. This poses a huge risk to the general public as a driver falling asleep at the wheel can prove to be fatal for the other vehicle.

3  Truckers many times are forced to pull over on the side of a road to rest, many times on an exit or entrance ramp, causing extreme highway safety risks for themselves and the general public.

4  Finally, drivers are forced  many times to park in unsafe surroundings in order to get their much needed rest. This was the case for Jason Rivenburg, who parked in an abandoned gas station which resulted in his violent death. Jason was an open target for predators as he parked in an isolated area and  was shot and killed before he could make his early morning delivery.

Yesterday’s calling campaign to Washington was a success as supporters from the trucking industry stood together and joined forces to get HR 21 56 passed.
The next stage of this campaign needs to be the spreading of awareness to the general public who are unaware of the extreme safety risks they are subjected to on our nations highways. Although the trucking industry represents millions of truckers and transportation employees, it is the general public of the highways that must be aware of the dangers and to also be in align to support the passing of this bill.  They must realize that a tired driver unable to stop for rest could be driving along side of them on the highway.

We personally, once again, made numerous call to the representatives in our state of Florida explaining the dire need for Jason’s Law. We also called all 4 offices in the committees which the bill appeared to be “stuck” in, namely the Transportation and Infrastructure Committee and the Highways and Transit Subcommittee.

The most helpful person among all of our phone calls was Todd Kohr from the office of Jim Oberstar, who is the Chair of the Transportation and Infrastructure Committee. Although the answers to our questions that we asked were not encouraging, the honesty and transparency was appreciated.

According to Todd Kohr, professional staff member for the Highways and Transit subcommittee, he stated that the reason the bill is not moving is because there are similarities to what Jason’s Law is attempting to achieve in another broader bill, the Surface Transportation Authorization Act.

Now, here is the problem:

When the need for truck parking is attached to another bill, Surface Transportation Authorization Act, and many other transportation needs are also attached, the allocated funds would be dependent upon the other proposals within the bill. This has been the problem for many years now when we look at the track record for providing funds for long term truck parking. Truck Parking Funding  gets lost on the shuffle of “other interests”

Todd Kohr also mentioned another Pilot Program, The Truck Parking Facilities Pilot Program which is under SAFETEA LU (Safe, Accountable, Flexible, Efficient, Transportation Equity Act) which was awarded 25 million over 6 years for truck parking ( THROUGH 2009).
USDOT recently released 6 million dollars to 5 states from this Pilot Program funding: Tennessee, Mississippi, Pennsylvania, Utah, and Oregon.

As we mentioned to Mr Kohr, The Truck Parking Facilities Pilot Program, is a mere drop in the bucket in comparison to the bill, Jason’s Law, which will also be a Pilot Program for meeting the additional  long term truck parking needs, but will be 120 million dollars over a 6 year period. Oddly enough, the 120 million dollars for Jason’s Law has been criticized by many, stating that  20 million dollars per year is not enough to cure the deficit of truck parking facilities. If so, then The Truck Parking Facilities Pilot Program, only awarding 6.25 million dollars per year, surely will not even come  close to meeting the needs for this huge truck parking problem . The other broad bill for transportation, Surface Transportation Authorization Act, which on paper includes addressing truck parking, doesn’t even define ( nor could Mr Kohr tell us in dollars) a predetermined amount of funds which would be allocated for the severe shortage of truck parking.

Our suggestion to the Transportation and Infrastructure Committee and the Highways and Transit Subcommittee, is to seriously reconsider the safety needs of the general public and the professional truck driver by passing Jason’s Law as it’s own bill, thus securing allocated funding for the drastically needed truck parking facilities which are causing havoc among drivers along with compromising the lives of those sharing the highways with 80,000 lb trucks.

It is only when Jason’s Law, HR 2156 is passed into law, that the truck parking problems will be adequately addressed and targeted funding will be used for this purpose and this purpose only. It’s obvious now, after more than 10 years of addressing the shortage of truck parking, that attaching it to a “broader bill” just does not work.

Continue to call your state representatives and tell them you want Jason’s Law as it’s own bill, not tucked inside of a broader bill

Monday June 28th, 2010, the trucking community stands in unison together for their support of Jason’s Law

With all the issues existing within the trucking industry today, none have brought together a more unified atmosphere among truckers, bloggers, organizations, social media participants, and radio shows, than the desire to see the much needed bill, Jason’s Law (H.R. 2156  and S971) passed into law.
The  Jason’s Law bill will allocate 120 million dollars over a 6 year period to ensure that safety improvements are made ( including SAFE adequate truck parking) for rest areas and truck stops.

Hope Rivenburg, the widow of Jason Rivenburg for whom this bill is named, has made Monday June 28th, 2010 as the day for everyone to call their Senators and Representative and strongly urge them to Support Jason’s LawThe trucking community has strongly supported this day in unison together.

As you most likely know, Jason Rivenburg was murdered as he parked to rest in an abandoned gas station because he could not find safe suitable truck parking for his early morning delivery. Adequate and safe truck parking has been a major concern of truckers for many years, with promises in the past made to remedy the problem.
We are now all standing together to ensure that something be done and that the death of fellow truck driver Jason Rivenburg has not been in vain.

Jason’s widow Hope, has made numerous trips to Washington, urging lawmakers and government officials to support Jason’s Law. In a year when highway safety has taken a significant increased priority among government agencies, this bill should be 100% supported and should have been passed by now.

Hope and Congressman Paul Tonko, who is the originator of the bill HR 2156, has also made numerous pleas  on Truth About Trucking “Live”, Allen Smith’s  blog talk radio show. Hope and Congressman Tonko have also been guests discussing Jason’s Law on TruckStar Radio with Daniel Audet.
Hope was recently a guest on Road Dog Trucking Radio on the Lockridge Report, sharing her story and urging listeners to support this day. Many of the other shows on Road Dog Radio have also made numerous mentions of the June 28th Call to Action, strongly supporting this day and urging their listeners to take action.

Organizations are supporting this badly needed bill, including OOIDA, who on June 24th released a National Call to Action to their members for the participation of the June 28th Calling Campaign to Washington.

The Teamsters and ATA have also supported the need for Jason’s Law.

Now we must ensure that the government officials whom we’ve elected into office, do their part in recognizing the need for HR 2156, Jason’s Law. For some reason, this bill has been “stuck” in the Transportation and  Infrastructure Committee. James Oberstar of Minnesota  is the chair and John Mica of Florida is the ranking Republican.

The Subcommittee that appears to be “sitting on this bill” is the Highways and Transit.
Highways and Transit is chaired by Pete Defazio of Oregon and John Duncan Jr. of Tennessee is the ranking Republican.
Ironically, John Duncan has recently written an article about the dangers of distracted driving, obviously concerned about the “safety of drivers.”

During his campaign for Presidency, President Obama stated that the problem with human trafficking in America would have to be a top priority.  Other than a post written for the Washington Post in June, 2009 by Hillary Clinton, like administrations’ before him, nothing has really been done.  Perhaps Governmental officials just do not know how to tackle this $32 billion worldwide industry.   Others however, are stepping up to draw attention to this horrific crime and they are looking at professional truckers and trucking companies for assistance.

In the past few weeks, the National Hotline has received numerous calls from truckers across the nation concerning human trafficking activity as a result of Truckers Against Trafficking and an interview with Chapter 61 Ministries.   Federal agents have stated that they have been very pleased with the tips received from truckers.  Please continue to call in tips and help put human trafficking perpetrators behind bars and rescue trafficking victims.  The toll free hotline is 1-888-373-7888.

Kylla LeeburgAs a founding member of Chapter 61 Ministries, Kylla Leeburg has been instrumental in organizing grass-roots efforts to fight the issue of human trafficking in the state of Oklahoma.  A former missionary in El Salvador, she has seen first-hand the devastation and long-term impact abuse, oppression, injustice and slavery, whether economic, social or sexual, has on people, from generation to generation.

Kylla has stated:   “I have always been drawn to justice issues, whether it was working for human rights for gang members and glue sniffers in San Salvador or now working for the victims of human trafficking.  I just believe we each have a purpose beyond ourselves in this world, and we need to step up and do our parts.”

In the three years since Chapter 61 Ministries formed, Kylla has worked to educate and bring awareness of injustice and human trafficking issues to the students and faculty in the high school where she teaches as well as to educational institutions throughout the state of Oklahoma.  She has written articles and editorials on the issue for publications and has provided presentations and webinars on human trafficking and truckers against trafficking in a variety of settings, including the Big Rig Expo in Tulsa last October.  She has participated as a panel member on human trafficking and taken part in committee and task force action teams.

The Truckers Against Trafficking initiative, which Chapter 61 began in March 2009, is the direct result of an idea birthed from information Kylla  gleaned at the first national human trafficking awareness conference Chapter 61 Ministries put on in October 2008.  Members of the trucking industry, by nature of their jobs and the high visibility and presence they maintain on our nation’s highways, can play a critical role in bringing this heinous crime to an end and seeing perpetrators brought to justice and victims released.   “All they need is to understand the problem and be given the education, tools and tips to join the fight effectively.”

Monday evening  Nov 9, 2009, Dan Rather Reports videoed  part 2 of an ongoing  trucking industry  investigation at  Willies Place Truck Stop in Carl’s Corner, Tx. The objective of this broadcast was to follow up from the Show of October 20th, Queen of the Road” where Trucker Desiree and Tom Hansen discussed the poor practices going on in trucking, specifically the students in the CDL training mills and the new driver company training programs.

When the drivers first drove up and were entering Willies Place, some were confused, thinking that the show may create a poor image for drivers. After talking with many of them they soon realized that the intention of the show is to actually improve the image of the American driver by confronting the many scams that so many of them have faced throughout their career.  The CDL school mills and new driver training programs are just 2 programs which are hurting the image of the drivers. This is because by churning out so many inexperienced drivers, not only are veterans being starved out of the business by newer lower paying drivers, but the lack of experience by these new drivers is not a true symbol of Dan Rather Reports Truck Talkthe excellent driving skills which so many veterans possess.  I personally talked at length with trainer Jimmy Watson of KLLM. Jimmy at first came to Willies Place concerned about the possibility that his reputation would be damaged by exposing poor training tactics of other companies. It wasn’t until I explained that by exposing and eliminating the poor training practices of other companies, that his company would not have to endure any kind of negative stigma which may result from them.

In this week’s follow up, “Truck Talk “, Dan Rather visited the big truck stop at Carl’s Corner, Texas, to hear from others within the trucking Industry. Truckers from across the country were encouraged to attend the live videoing of the follow up program so they could witness first hand the questions and discussions going on among Dan Rather and the stage panel: Todd Spencer ( executive VP of OOIDA), Michael Belzer ( Economics Prof of Wayne State), Miles Verhoef ( O/O), Derek Leathers (COO of Werner ENT), Tom Dean( Veteran Driver for Werner Ent) and Guest audience speaker Allen Smith of AskTheTrucker.com.   Many Truckers were in the audience including Desiree Wood from the first Dan Rather Reports trucking Video, along with owner operators, company drivers, company trainers, and even a student who came to Allen for help regarding a wrongful statement on his DAC report which has ended his short lived trucking career of less than 1 year.

As you will see after viewing the Dan Rather Truck Talk video, the greatest part of this program has been the fact that it has brought truckers, blogs and organizations together, discussing the problems and issues within the trucking industry. As you are aware, Allen Smith has been an advocate for students and drivers and has been talking about the scams within trucking for quite a number of years now. TruckerDesiree and Allen, AskTheTrucker, for the last year have had a synergistic relationship, fighting for the rights of students, new drivers, the harassment women in trucking trainees, and even the veterans who are being starved out. Other issues only being addressed by Allen, are the DAC abuse and the Trucking Lease Scams,which hopefully will gain the attention of others as they are crucial topics which must be addressed.

Now, we have  agreement with Todd Spencer of OOIDA, who personally told TruckerDesiree what a great job she did in the first video. Also notice in the video that Todd Spencer brings up how there never was a driver shortage, but the problem is the 125% turnover rate, something which Allen has been trying to explain to people for years and actually devoted a chapter to in his book, “The Truth About Trucking.” When I heard Todd say that, I wanted to jump out of my chair and personally hug him!!  I did mention it to him later, although I didn’t hug him… :)

I want to say that this meeting/forum at Willies Place has given me a hope that I have never felt before. I felt unity and comradeship, people standing around discussing problems together. I had a great talk with Norita Taylor, media spokesperson for the  OOIDA,  as we discussed things like the importance of Jason’s Law HR1256 and the CDL training problems.  Norita told me also that her boss Todd Spencer said that Desiree’s depiction of CDL training was right on,  and how great it was to be able to meet and speak amicably on all these important issues.

You see, we all need to have the same agenda, the same common goal….THE SUCCESS OF DRIVERS AND TO” RAISE THE STANDARDS OF THE TRUCKING INDUSTRY.”

The most recent Dan Rather Reports, a second in a series, filmed on location in Carl’s Corner, Texas at Willie Nelson’s truck stop, Willie’s Place – brought a large number of truckers together who had the opportunity to mingle and discuss problems within the trucking industry.  Owner Operators specifically, were sharing their concerns about the future of their livelihood.

Concerns such as opening the Mexican Border . . . the Cap and Trade issue . . . new EPA stipulations such as the SCR or EGR and its direct costs to the owner operators who for many, can barely keep their heads above water right now.

It was a good thing to see so many drivers discussing these important issues within the industry as long as it does not turn out to be just “more talk” as many of them shared with me was one of their concerns.

For the last few days there’s been a drive to try to assist  Hope Rivenburg and  family of slain trucker, Jason Rivenburg, to attend GATS!

The family plans on attending GATS in order to ensure that the Bill HR 2156 ( Jasons Law) is passed. They want to reach out to as many drivers as possible so they  understand the importance of supporting “Jason’s Law” which will be  part of a pilot program, expanding the amount of  safe parking, therefore reducing the risk of another family experiencing the tragic loss that they have had to endure.

Shortly after the first post was written TG Graff of GoTruckStop.com immediatley responded by offering his booth to Hope and family. He has since then started a donation drive, ” Get Jasons Law to Gats” encouraging truckers from all over to donate$5.00 to the fund.  It wasn’t long after that, others started to follow.   Power is in numbers and we all need to help  assuring that Jason’s family can attend GATS and represent the Bill which was started in his name.

Today TJ left a comment on the original blog post. This is what he wrote:

Will Hope Rivenburg and Family be at GATS? With a little help from…….. OOIDA or the ATA

The families of Murdered Truck Driver Jason Rivenburg are continuing their campaign for “Jason’s Law”, H.R.2156, which will implement a pilot program to address shortages in safe parking for commercial motor vehicles on our National Highway System.   It is necessary that we continue to collect as many signatures on the petition as possible in order to ensure the passing of the bill.  Jason’s Law will create the 6 year Pilot Program  in the amount of 120 million dollars in grants over a 5 year period.The legislation allows the Secretary of Transportation, in cooperation with appropriate State, regional, and local governments, to allocate funds to improve rest areas that serve the National Highway System.

Whenever I speak to Hope Rivenburg ( Jason’s Widow), gratitude just pours out of her. It’s quite humbling to speak to someone who has gone through so much, and yet so much of her words are in appreciation of others.  She appreciates all the websites and blogs who have helped in the support of “Jason’s Law”, no matter how small or large they are,  all the individuals who have expressed their most sincere condolences, and everyone who has signed the petition.

Along with the many individuals, trucking blogs and websites such as this one, there are 2 major organizations who are supporting   Jason’s Law… OOIDA and The ATA.

During my conversations with Hope,  she has expressed that she is also very grateful for the support of both The ATA and OOIDA .  She said that OOIDA wished her the very best in all her endeavors when she had  first  contacted them about the proposed bill .  Hope said that  it wasn’t too long after though, when Congressman Paul Tonko (D-NY) released the draft of the bill  “Jason’s Law” or H.R. 2156,  they  came to bat and  supported  the family and the bill through magazine postings and calls to action.

Hope and her family initially met with Congressman Tonko on March 14th, 2 days after Jason’s funeral, in a coffee shop in New York State, to discuss the need of the bill. Since that first meeting,  Hope  and her family members have worked tirelessly in order to make sure that this Law passes and that another family does not have to endure the same kind of tragedy or loss.   You can read the family Journal which gives an account of the struggles and progress which they share on their Blog

On April 28th Congressman Paul Tonko introduced legislation H.R. 2156 in the House titled “Jason’s Law,” which would implement the pilot program to address shortages in safe parking.  I think Paul Tonko’s name is engraved on the hearts of Jason Rivenburgs family, as well as many others who are grateful for his initiative in introducing “Jason’s Law.”

OOIDA Executive Vice President Todd Spencer said Tonko’s bill is a “good one” and urges members to call their representatives and educate them about how this bill will help provide safe parking for truckers.  “We need to pursue whatever is possible to expand the amount of parking in areas where it’s so desperately needed,” he said. Shortly after, the ATA quickly jumped on board and strongly supported HR 2156 and S971. In an article posted  May of  this year in FleetOwner Magazine, “Jason’s Law: ATA pushes for quick passage of truck-parking measure”  President and CEO Bill Graves stated,  “The parking shortage for commercial motor vehicles comprises the safety of drivers out on the road and requires a comprehensive solution involving all interested parties.”

This is a time when it is necessary that we all stand together ( as we are).  Drivers, Trucking Blogs and Websites,  OOIDA, the ATA and everyone else who is concerned about the safety of drivers’ lives out on the road and the desire to see” Jason’s Law” a reality( not a dream) are in unison together.

This August The Rivenburg and Hardendorf family members are hoping to attend The Great American Trucking Show ( GATS) in Dallas, TX.  It is their desire so set up a booth and run their campaign, to reach so many thousands more about “Jason’s Law”, providing their many pamphlets, T-shirts, bracelets, etc….educating people about the  crucial need and vital importance of this legislation.

As you can imagine, cost of the trip for the family members and the added cost of a booth at GATS, can be quite expensive.

I asked Hope Rivenburg if she would accept sponsorship from either The ATA or OOIDA for their campaign at GATS.  She was thrilled and deeply moved at the thought of a sponsorship.

It is at this time we would like to make our plea for Sponsorship to both the ATA and OOIDA for the Rivenburg and Hardendorf family members. Please reach out and help them, as they have endured so much, and yet remain dedicated and loyal to the cause of  their passing loved one and his fellow brother and sister truck drivers. We know how important this bill is to you, imagine how much more important it is to Jason’s family.  Their presence at GATS will surely impress  and imprint the hearts of thousands more.

The state of Virgina had been forcing Truckers to break Federal Law by waking them up after only 2 hours of rest( parking,) before they could complete their 10 hour rest/break required by Federal law. Besides forcing them to break Federal law, a serious safety risk was at stake by allowing sleepless drivers to share the roads with other innocent drivers and vehicles.

Although the 2 hour parking law in Va had been in existence for many years, it was the relentless and persistent approach of Fred and JB Schaffner of The American Driver , which would eventually lead to the victory of ending it . Their continuous phone calls, letters, and even petition to the FMCSA, created an onslaught of followers and eager participants to help in their quest to end this dangerous law.  JB and Fred got the ball rolling and and did not allow any obstacle to stop it’s momentum.

We would like to thank JB, Fred, and the many supporters who have contributed in the efforts to change the 2 hour Parking law in Virginia to an ” no overnight parking” rule. We also would like to thank Mr Jeffrey Caldwell, VDOT Chief of Communications, who played a major role in the change of this 2 hour Rule.   Mr Caldwell was willing and gracious enough to address the situation on April 15, 2009 on Truth About Trucking Live Blog Talk Radio Show with Host Allen Smith, and guests JB and Fred Schaffner.  You can listen to the show and hear JB and Fred Schaffner as they ask Mr Caldwell  to address the serious issues facing truck drivers as they travel through Virginia.

We’ve spoken to JB and Fred on numerous occasions, and this victory is now in the past. They’re already addressing other issues on their agenda in order to aid drivers towards a better future.  We’re grateful to them and to ALL who have recently joined forces together, sharing our one common goal and interest of, “raising the standards of the trucking industry.”
