Congressman Paul Tonko Discusses Jason’s Law

Congressman Paul TonkoNew York Congressman, Paul Tonko was our guest on Truth About Trucking “LIVE” talk radio, Thursday, February 18th, 2010 at 7 PM EST.   Discussion focused on House Bill H.R. 2156, also known as Jason’s Law.   As per the bill, top priority will be given in order to:   “address the shortage of long-term parking for commercial motor vehicles on the National Highway System.” In general, the Secretary of Transportation “shall allocate funds made available to carry out this section among States, metropolitan planning organizations and local governments.”

Furthermore, this important bill calls for  “constructing safety rest areas (as defined in section 120(c) of title 23, United 22 States Code) that include parking for commercial motor vehicles.”   In addition to:

  • Constructing commercial motor vehicle parking facilities adjacent to commercial truck stops and travel plazas.
  • Opening existing facilities to commercial motor vehicle parking, including inspection and weigh stations and park-and-ride facilities.
  • Promoting the availability of publicly or privately provided commercial motor vehicle parking on the National Highway System using intelligent transportation systems and other means.
  • Constructing turnouts along the National Highway System for commercial motor vehicles.
  • Making capital improvements to public commercial motor vehicle parking facilities currently closed on a seasonal basis.
  • Improving the geometric design of interchanges on the National Highway System to improve access to commercial motor vehicle parking facilities.

Congressman Tonko addressed the importance of Jason’s Law and fielded questions concerning the many misconceptions about  House Bill H.R. 2156.   Questions were given by Project World Awareness and the Congressman cleared up the rumors being spread about Jason’s Law.

One caller, Andy Warcaba of Andrew J. Warcaba & Associates, called in as well, to discuss the problem with the building of safe parking for commercial trucks.

Truckers HOS Rule Should Provide Safety, but Also a Livable Wage

Tanker ExplosionWith the average number of miles driven per year by professional truck drivers, the dangers of living life on the road increases far beyond what the average motorist experiences.  Averaging ten times more miles driven per year than the general motoring public, the professional trucker is by far, the safest driver on the road today.  According to studies done by various unbiased groups, including the AAA, automobile drivers contribute more to fatal car-truck crashes than do the actions of truck drivers.   Although every truck driving job requires the skill of a professional driver, there are those which come with a higher degree of danger.

Normally providing a higher pay rate, drivers involved within the petroleum carrier industry can often become like any other veteran driver with years of experience under their belts . . . relaxed, complacent . . . whatever you want to call it . . . this complacency can become a hidden danger for all truck drivers, especially those involved in the transportation of fuel and other hazardous material, and most often, with deadly results.

With all the stress placed on truck drivers, through over crowed highways, forced dispatch and an endless array of Federal Regulations, trucking companies and officials need to fully understand and realize the true importance of safety.  Not just bureaucratic talk and pleasing self-interest groups, but understand that when additional pressures are placed on our men and women in trucking, additional consequences can occur, not only on our truckers, but the general public as well.

Professional drivers need the proper rest required by the human body and at the same time, they need to provide a living for themselves and their families.  Veteran drivers have no problem running ten, eleven or even fourteen hours in a day . . . this is why they are professional drivers.  As the FMCSA looks to further change the hours of service for truck drivers, they should maintain the 34 hour restart and provide more flexibility with the sleeper birth and the 14 hour provisions, as stated by the ATA.   Furthermore, the American Trucking Association also states that rest periods should not be mandated, but the FMCSA should adopt an optional rest period that would not be counted toward the 14 hour rule.

If changing the hours of service rule for drivers, once again, the FMCSA could not take away from the current HOS rule, but add to it . . . those provisions that not only will provide additional safety factors towards drivers and the general public, but also maintain the ability for truckers to provide a living for themselves and their families.   Professional truckers are up to the task in facing the lifestyle of a truck driver.  They understand the importance of safety and are well prepared to abide by all regulations.   The FMCSA should understand that there are ways to increase safety and still not interfere with a drivers’ means of support.

Accidents are largely caused by fatigued drivers who are not purposefully wanting to break any rules, but only working that much harder in the time allowed to bring in a decent pay check.  Allow drivers to drive . . . provide for adequate resting periods, but do not take away what little they have in the current rules that keeps them rolling, but add additional safety measures that will increase their ability to earn a livable wage and still give them the rest they need to keep safety as a priority as well.

Life as a trucker has enough stress, worry and dangers involved, being constantly concerned with paying the bills and putting food on the table should not be one of them.

How to Remove False Information From the DAC Report

Allen SmithIt is a constant battle.  Thousands of truck drivers unable to find another truck driving job due to false information having been reported to their DAC report.  The number of drivers affected is unknown.  Other false information is constantly being spread through-out the internet, such as one poster stated that the information on the DAC report is 99.9 percent accurate . . . yet, the poster provides no evidence of where this number comes from.  Of course, it is a percentage that he has just pulled out of the air, based on whatever his agenda is.   It is often not difficult to discover why such behavior goes on.  Such as the case of this poster making the 99.9% comment.  Hiding in the forum as a “driver” he is in fact,  an owner of a trucking company.  I prefer to deal with facts, not whimsical numbers and exaggerated statements from a trucking forum that will not allow those drivers to post their DAC stories and show their support of the  Stop False DAC Reporting petition.

Another trucking forum refused to allow us to post the link to the  DAC petition to their forum saying that we were “only trying to advertise.”  Perhaps I am naive?  I assumed that trucking forums were for the drivers?  If not, what do you think they are for?

Furthermore, when you dig a little deeper, trying to discuss the issues facing the industry and drivers today, I will receive a post back similar to:  “You are only trying to sell your eBooks.” Forget about the time spent answering emails, returning phone calls, posting to this blog, broadcasting our Blog Talk Radio show . . . it is all about “trying to sell your eBooks.” Once again, confirming my past article:  The Truck Driver’s Worst Enemy.

This is why I am not big on trucking forums.  There are only a handful of trucking forums that provide excellent, fair and honest postings.  As CDL students or new drivers, realize that whoever is answering your questions you post to the forum, you have no idea who they are.  One example is where a new driver asked a question about a certain trucking company and wanted to know if it was a good company to go to.  The answer he received was very positive, praising the company and advising him that it would be a great company to get on with.   A few months later the new driver was back in the forum, telling his poor experience with the company.  It was later identified that the answer had come from a recruiter of the said company.  Remember, this is still the internet . . . when asking advise and opinions inside these trucking forums, etc., it could be anybody with an impressive “handle” giving you advise.    A key sign to a poor forum is when you try to post a comment that is biased against the conversation that is occurring, and they will “not allow” your comment to post.  This is a sign the trucking forum or other various site, has an agenda of some kind.

I will generally get pulled into posting on some forums, but I mainly stay away.   Most of the forums just want to do what they have been doing for years and years . . . just the same old talk and “blah, blah, blah” but never really standing up and taking any action of any kind to help raise the standards of the trucking industry for both, the industry and drivers.  Taking actual “action” for a good cause is too much work.  The “blah, blah, blah” is much easier to do.

As far as complete accuracies for the DAC report, I have no idea what the numbers are.  Even if the 99.9% is correct, (which it is not), with four million active CDL drivers in the United States, that would mean that 4,000 drivers have had false information placed on their DAC report, ruining their livelihood.  Yet, I have received hundreds and hundreds of emails and letters from drivers across the country sharing their DAC stories with me, as well as having received, thus far, 1,043 signatures on the DAC petition.  Furthermore, I have received a large number of emails from drivers wanting to sign the petition, but fear being identified by their employer and losing their jobs.  I completely understand and would not want anyone to sign the petition if they thought they could lose their job for doing so.  Even if the number is only 4,000 drivers affected by false DAC reporting, what should we do?  Just leave them blowing in the wind?

Whether or not we can reach the number of signatures needed for State Representatives, Congress and the Senate to take notice, remains to be seen.  There is much more  to bringing about reform on an issue than just having a petition.  It takes letters, phone calls, emails and various means of drawing attention to the fact that the cause is worth the attention of those with the power to bring about the reform.  The best example of this is the undying desire shown by the Rivenburg family for House Bill H. R. 2156, Jason’s Law.

Will we make it?  I don’t know.  But unlike most of these trucking forums which choose to just send out meaningless chatter and find it too hard to stand up for a cause to help the industry and, most importantly drivers,  if we don’t make it, we can at least say we tried.  At least we stood up and took action . . . we did something.  I am continuing with the DAC cause and will further wait to see how it is shaping up . . . I have a lot of patience.

Recently I have been getting quite a few emails from some of you facing false information on your DAC saying that you “quit without notice” even though you advise that you never even worked for the company, only attended the orientation.  This is how a trucking company can place this on your DAC Report:

Once a company has assigned you a driver number, you are officially employed.  This number assignment is done during the orientation, in order to have you ready to go on your first load.  Even if the company tells you to go home and wait for your first load, having the driver number assigned to you and having been placed in their system, you are officially hired and an employee.   If you decide to call the next day and tell them you have chosen not to take the job after all, the company has to pay the accounting department, the HR department, etc., in removing the assigned number from you and pulling you out of their payroll system.  Not to mention the time and money they have put in with the training, motel expenses, food expenses and so forth.   Once that driver number has been assigned to you, legally your employment with the company has been accepted.  Even though you never actually drove for them, legally they can report that you quit without notice.

Is it the moral thing to do?   No.   Is it the ethical and right thing to do?  No.  Is it legal?   Yes.   Due to false information being placed on drivers’ DAC reports, naturally you want to work at having it removed.  The first thought is SUE!  The DAC services are very acquainted with law suits and will not even blink an eye at this threat.   The proper way to handle removing false info from the report, is to follow the procedures laid out by DAC.

  • Receive a copy of your DAC Report
  • File a Dispute
  • Provide a written statement accounting your side of the story

Sounds simple, right?   Here’s the key aspect that you need to understand about how to remove false information from the DAC report.  Its’ very simple . . . you must have verifiable, tangible, physical . . . some kind of PROOF showing that your account is indeed fact.  Without proof, without evidence, chances of having the false info removed is very slim.

They have specific procedures for drivers to follow to begin the dispute process and having false info removed from the report. The main reason drivers have trouble having false info removed, is because the driver has no physical or verifiable proof.

This was further ruled on from the ruling of the April, 2009 court case:

Eaton vs. Raven Transport

“The above case teaches that to hold the trucking company liable, the allegation MUST not only allege that the trucking company made a false report to DAC;  but that there MUST be sufficient evidence showing that the trucking company knew their report to DAC was false when it was made to DAC.”

Based on this case, it was determined by the courts that:

“The transport company cannot hide behind a “qualified privilege” when it makes intentional false statements on the DAC report.  The transport company will be held legally liable for such intentional and malicious conduct. Not only will the company be liable for compensatory damages resulting from the truckers’ inability to obtain work;  but its malicious conduct warrants punitive damages.”

Here is the actual quote determining the win for the driver:

“Plaintiff is a pro se litigant pursuing a claim related to losing his job as a truck driver. …Plaintiff has accused Raven of making defamatory statements about him to the EEOC and the DOL as well as to a potential employer, D. Krutiak Trucking (“Krutiak”). Raven has also been accused of releasing defamatory statements in a DAC Report, an employment-history database for motor carriers. Raven has moved to dismiss on the grounds that the statements that they made were privileged and not subject to liability.

Plaintiff claims that these statements were knowingly false and have made it difficult for him to secure other employment….. (a) An employer or any person employed by the employer who discloses information about a current or former employee’s job performance to a prospective employer is presumed to be acting in good faith; and unless lack of good faith is shown, is immune from civil liability for such disclosure or its consequences. For purposes of this section, the presumption of good faith may be rebutted upon a showing that the information disclosed by such employer was knowingly false, was deliberately misleading or was rendered with malicious purpose; or that the information was disclosed in violation of a nondisclosure agreement, or was otherwise confidential according to applicable federal, State or local statute, rule or regulation.

This privilege carries a rebuttable presumption of good faith. Qualified privilege will not attach to the DAC Report or Raven’s communications with Krutiak if they were knowingly false, deliberately, misleading, or rendered with malicious purpose……..Plaintiff has alleged that Raven’s statements were knowingly false and rendered with malice. Since this Court must assume that these allegations are true for the purposes of this motion…Plaintiff’s defamation claim for the DAC Report and for communications with Krutiak cannot be dismissed now…

Considering the foregoing, Raven’s Motion to Dismiss is DENIED”

OOIDA Land Line Magazine Should Hear From CDL Students and New Drivers

Land Line Magazine, the OOIDA business trucking magazine, reported on the recent Dan Rather Reports TV Show in which I was invited to as a special speaker from the audience.  In the article they wrote:

Rather turned to an audience member, Allen Smith, who has spent 30 years in the business.  Smith claimed he has received thousands of responses on his site, askthetrucker.com, since the “Dan Rather Reports” episode aired featuring Wood.  ( misquote)

“The schools are still taking their money.  They’re wasting their time in the truck knowing that within a couple of weeks they’re going to be thrown out of the truck anyway,” Smith said.

Although I’m sure Land Line would never admit to receiving the volume of emails we have received from all of you since our site began, all of you CDL students and new drivers out there who have experienced these abuses you have shared with AskTheTrucker over the years, should consider also sharing your stories directly to OOIDA and their Land Line Magazine.

In fact, here is an email we just received a few hours ago from a gentleman who wanted to share his nightmare story of his Owner Operator Lease Purchase Program, which I have discussed many times.   For Land Line Magazine and OOIDA . . . this is just another one of the thousands we have and continue to receive:

Dear Sir:

I have settled down a bit, so let me put things into perspective and give you some more info:

I am near the end of my 5th week with ********.  I will get my 4th settlement statement tomorrow.  I am a rookie driver – all my  experience is these 5 weeks, plus ******** driver training program.  My driver trainer was a lease op, he convinced me that I would make much more money as a lease op.  I was convinced by many ******** people that leasing my truck would provide me more income, more flexibility in various aspects of the job.   I got back to the yard, tested out, and one of the instructors talked to our group about leasing.  He pulled me aside, and of course I had already made up my mind to do it…long story short, he gets $300 bonus for every one he can get to sign up.  And I did so.   It has turned into a nightmare.  I was making more money ($330 a week)  with Georgia unemployment than with this company.

My settlements so far during my short career have been:  $755 for week 1, $305 for week 2, $56 for week 3, week 4 comes out tomorrow, and of course here I sit broke down from Sunday Nov. 8 to probably Sat. Nov. 14, so when I get the settlement for this week, it will be deeeeep in the hole no doubt.   Those figures
are before taxes and Soc. Security, which I have to pay quarterly.  I probably wont have to pay anything as I had worked in the corporate world in my old job for a half year in 2009.   I have to drive 1800 to 1900 miles to “break even”.

I am told that ******** Trucking receives $30,000.00 from the US Govt. for every new driver it trains and puts on the road.  At the same time, this company has a 120% turn over rate, and it’s because the lease ops are making the truck payments on a fleet of lemons (Cat C-15 engines with problematic Regen systems), and the Drivers (lease or company) are not getting enough miles to earn a living.  What do you think, is it a scam?   Or is aall of the trucking industry just like this??    This is a “$30,000 a head personnel factory” funded by our tax dollars.

Five weeks is not a very long time, perhaps it reduces the impact or legitimacy of this story, you know, here is a guy just whining or whatever, but to me it is very big… I did this as my answer to being laid off from the corporate world, my big career change, a new beginning.

I am planning to complete my 90 day obligation to *******  and then give my 2 weeks notice to break the truck lease.  At least there is a 2 week walk away clause.  Today is Nov. 12, and I have been broke down since Sunday Nov. 8th, and I have to continue making lease payments,  pay my own hotel bill, and basically just wait until it is fixed.  Yes I signed a contract, I knew what I was getting into, but I did not expect I would be issued a lemon.  My truck had 238 thousnad miles on it – just broke in, they all said.  They do offer a truck rental at *******, but I wont be down long enough for it to work out – it would be time to come back up here  & get my truck after only say 1 run in the rental (from back at the yard in *******), and by the way, there are no rentals available right now anyway.  I checked yesterday (Nov. 11).   So, my truck will be issued to the next victim, and this puppy mill will continue to generate $30,000 government payments.

I guess I am a complete idiot.  Trucking has turned into a nightmare in only 5 short weeks, I have gotten a real education.  I think it is God trying to tell me something.  I await some kind of sign from Him, or maybe its that simple: that he wants me to go home and not be a truck driver??  I know this has hurt my wife badly, and I am lonely as hell.   What can I say?   I can do this work, I know it, but I cannot survive at the abysmal level of income.  If I had some other source of income, it would be OK to stick with it and learn the ropes, get the experience, and so on.  I believe trucking has a chance to come back like the old days, I believe that is why the old veterans are hanging in and running on.

I cannot afford it.

If you can use any of this please do so.  Bear in mind I still have to work with ****** for 4 more weeks or so to fulfill my 90 day obligation – that covers training expenses.  They say they can charge me with it if I leave early.

Hi ******** :

I’m really sorry this has happened to you and is the reason we are working so hard to expose these scams and abuses by the trucking industry, from those companies and schools which are allowed to operate in these abusive manners.

I don’t have to tell you that “yes” in many cases, these lease purchase plans are nothing more than scams. There are good companies out there with good lease programs.  I cannot really say about the company you mentioned, but again, this lease purchase programs show to have an 87% failure rate.

They are simply designed for a driver’s failure by many companies.  Understand, you ARE NOT AN IDIOT! Sounds like you are just another victim of the abuse and scams of the trucking industry that we are working to expose.  I cannot verify the $30,000 you mention – that sounds very high to me – but I will look into it.

Industry leaders will always say that it’s YOUR fault … but trust me … it’s not.  It’s their fault for allowing these scams and abuses to continue.

I’m sorry that once again, another newcomer to the industry who only wanted a new career and a way to support their family, has been victimized by this industry.  We will keep fighting to expose the truth.

The Quest for The Truth About Trucking with Dan Rather Reports

Monday evening  Nov 9, 2009, Dan Rather Reports videoed  part 2 of an ongoing  trucking industry  investigation at  Willies Place Truck Stop in Carl’s Corner, Tx. The objective of this broadcast was to follow up from the Show of October 20th, “Queen of the Road” where Trucker Desiree and Tom Hansen discussed the poor practices going on in trucking, specifically the students in the CDL training mills and the new driver company training programs.

When the drivers first drove up and were entering Willies Place, some were confused, thinking that the show may create a poor image for drivers. After talking with many of them they soon realized that the intention of the show is to actually improve the image of the American driver by confronting the many scams that so many of them have faced throughout their career.  The CDL school mills and new driver training programs are just 2 programs which are hurting the image of the drivers. This is because by churning out so many inexperienced drivers, not only are veterans being starved out of the business by newer lower paying drivers, but the lack of experience by these new drivers is not a true symbol of Dan Rather Reports Truck Talkthe excellent driving skills which so many veterans possess.  I personally talked at length with trainer Jimmy Watson of KLLM. Jimmy at first came to Willies Place concerned about the possibility that his reputation would be damaged by exposing poor training tactics of other companies. It wasn’t until I explained that by exposing and eliminating the poor training practices of other companies, that his company would not have to endure any kind of negative stigma which may result from them.

In this week’s follow up, “Truck Talk “, Dan Rather visited the big truck stop at Carl’s Corner, Texas, to hear from others within the trucking Industry. Truckers from across the country were encouraged to attend the live videoing of the follow up program so they could witness first hand the questions and discussions going on among Dan Rather and the stage panel: Todd Spencer ( executive VP of OOIDA), Michael Belzer ( Economics Prof of Wayne State), Miles Verhoef ( O/O), Derek Leathers (COO of Werner ENT), Tom Dean( Veteran Driver for Werner Ent) and Guest audience speaker Allen Smith of AskTheTrucker.com.   Many Truckers were in the audience including Desiree Wood from the first Dan Rather Reports trucking Video, along with owner operators, company drivers, company trainers, and even a student who came to Allen for help regarding a wrongful statement on his DAC report which has ended his short lived trucking career of less than 1 year.

As you will see after viewing the Dan Rather Truck Talk video, the greatest part of this program has been the fact that it has brought truckers, blogs and organizations together, discussing the problems and issues within the trucking industry. As you are aware, Allen Smith has been an advocate for students and drivers and has been talking about the scams within trucking for quite a number of years now. TruckerDesiree and Allen, AskTheTrucker, for the last year have had a synergistic relationship, fighting for the rights of students, new drivers, the harassment women in trucking trainees, and even the veterans who are being starved out. Other issues only being addressed by Allen, are the DAC abuse and the Trucking Lease Scams,which hopefully will gain the attention of others as they are crucial topics which must be addressed.

Now, we have  agreement with Todd Spencer of OOIDA, who personally told TruckerDesiree what a great job she did in the first video. Also notice in the video that Todd Spencer brings up how there never was a driver shortage, but the problem is the 125% turnover rate, something which Allen has been trying to explain to people for years and actually devoted a chapter to in his book, “The Truth About Trucking.” When I heard Todd say that, I wanted to jump out of my chair and personally hug him!!  I did mention it to him later, although I didn’t hug him… :)

I want to say that this meeting/forum at Willies Place has given me a hope that I have never felt before. I felt unity and comradeship, people standing around discussing problems together. I had a great talk with Norita Taylor, media spokesperson for the  OOIDA,  as we discussed things like the importance of Jason’s Law HR1256 and the CDL training problems.  Norita told me also that her boss Todd Spencer said that Desiree’s depiction of CDL training was right on,  and how great it was to be able to meet and speak amicably on all these important issues.

You see, we all need to have the same agenda, the same common goal….THE SUCCESS OF DRIVERS AND TO” RAISE THE STANDARDS OF THE TRUCKING INDUSTRY.”

Join Dan Rather from  Dan Rather Reports as he interviews our dear friend and fellow trucking advocate and activist TruckerDesiree. The theme of the show will be the inadequate CDL schools and the exploiting of new CDL drivers and trainees.

Almost 10 years ago my better half, Allen Smith ,wrote the book “The Truth About Trucking”, advising people on the correct paths to take and those avenues to avoid, specifically CDL school mills and trucking companies.  The motive?  To help folks achieve success within trucking and to prepare them for the lifestyle they would be facing.

Allen literally has received thousands of emails from people, but none so memorable as the one in September of 2008  from a new  CDL driver who had just gone through the mill……CDL Mill if you will.  The name of that Student?  Desiree Wood, affectionately known today as TruckerDesiree.

Desiree had written Allen and I numerous times, asking questions about trucking ( as so many do).  She had just been through some of the most difficult and stressful experiences during her CDL school training and her CDL company team driver training…and her descriptions were quite vivid and graphic!  She would write us long detailed emails describing her encounters…some of them making me cringe.  I finally asked her if she would like to share her experiences with our Blog readers and Newsletter subscribers.  She said yes she would and thus A Day in the Life of a Lady Trucker” and TruckerDesiree was born, and the trucking industry would never be quite  the same!

Well, it’s exactly one year today that TruckerDesiree made her debut in “AskTheTrucker” with the  first post in her journal, ” A Day in the Life of a Lady Trucker”.

A lot has happened since then for Desiree;  Talk Radio Shows, Trucking Magazine interviews,  documentaries, spokesperson for the iPhone Trucker App, blogger, twitter queen, facebook diva, and most of all a very good friend and advocate for truckers … She’s made a lot of friends and many enemies (goes along with popularity)  By far her interview with Dan Rather will be her biggest accomplishment to date, but we expect to see even more achievements in the future.
