Monday June 28th, 2010, the trucking community stands in unison together for their support of Jason’s Law

With all the issues existing within the trucking industry today, none have brought together a more unified atmosphere among truckers, bloggers, organizations, social media participants, and radio shows, than the desire to see the much needed bill, Jason’s Law (H.R. 2156  and S971) passed into law.
The  Jason’s Law bill will allocate 120 million dollars over a 6 year period to ensure that safety improvements are made ( including SAFE adequate truck parking) for rest areas and truck stops.

Hope Rivenburg, the widow of Jason Rivenburg for whom this bill is named, has made Monday June 28th, 2010 as the day for everyone to call their Senators and Representative and strongly urge them to Support Jason’s LawThe trucking community has strongly supported this day in unison together.

As you most likely know, Jason Rivenburg was murdered as he parked to rest in an abandoned gas station because he could not find safe suitable truck parking for his early morning delivery. Adequate and safe truck parking has been a major concern of truckers for many years, with promises in the past made to remedy the problem.
We are now all standing together to ensure that something be done and that the death of fellow truck driver Jason Rivenburg has not been in vain.

Jason’s widow Hope, has made numerous trips to Washington, urging lawmakers and government officials to support Jason’s Law. In a year when highway safety has taken a significant increased priority among government agencies, this bill should be 100% supported and should have been passed by now.

Hope and Congressman Paul Tonko, who is the originator of the bill HR 2156, has also made numerous pleas  on Truth About Trucking “Live”, Allen Smith’s  blog talk radio show. Hope and Congressman Tonko have also been guests discussing Jason’s Law on TruckStar Radio with Daniel Audet.
Hope was recently a guest on Road Dog Trucking Radio on the Lockridge Report, sharing her story and urging listeners to support this day. Many of the other shows on Road Dog Radio have also made numerous mentions of the June 28th Call to Action, strongly supporting this day and urging their listeners to take action.

Organizations are supporting this badly needed bill, including OOIDA, who on June 24th released a National Call to Action to their members for the participation of the June 28th Calling Campaign to Washington.

The Teamsters and ATA have also supported the need for Jason’s Law.

Now we must ensure that the government officials whom we’ve elected into office, do their part in recognizing the need for HR 2156, Jason’s Law. For some reason, this bill has been “stuck” in the Transportation and  Infrastructure Committee. James Oberstar of Minnesota  is the chair and John Mica of Florida is the ranking Republican.

Representative Jim Oberstar (D – 08) 202-225-6211

Representative John L. Mica (R – 07) 202-225-4035

The Subcommittee that appears to be “sitting on this bill” is the Highways and Transit.
Highways and Transit is chaired by Pete Defazio of Oregon and John Duncan Jr. of Tennessee is the ranking Republican.
Ironically, John Duncan has recently written an article about the dangers of distracted driving, obviously concerned about the “safety of drivers.”

Representative Peter DeFazio (D – 04) 202-225-6416

Representative John J. Duncan, Jr. (R – 02) 202-225-5435

I say we give all these folks in the committees a call and urge them to get the ball rolling for Jason’s Law.

*ALSO: Please call your own state representatives and senators :

Here’s the link

The entire process, including the phone call will take less than 5 minutes, but the positive effects for drivers will BE PRICELESS.

Jason's Law Bill H.R. 2156

Rivenburg Family

Hope Rivenburg, the widow of slain trucker Jason Rivenburg, along with Congressman Paul Tonko, AskTheTrucker, and everyone who has worked so diligently  to get HR 2156 passed into law, has designated June 28th 2010, the official day for Jason’s Law – Bill HR 2156.

Jason’s Law, otherwise known as Bill H.R. 2156, was introduced on April 28th, 2009 and has been referred to the House Committee on Transportation and Infrastructure. The Bill, named after truck driver, Jason Rivenburg of Fultonham, NY, who was found shot to death in his truck, would implement a pilot program to establish safe truck parking facilities.

What this day of recognition means is that on, June 28th, 2010, we are calling for EVERYONE to call their Representatives and Senators, telling them that it is imperative for them to support HR 2156 in order that truck drivers can have the promise of safe and adequate parking. We need to flood the phone lines and “Get Er Done”

This is a Bill that has the Support of everyone. With all the many differences that exist among one another within the trucking industry, we are all in unanimous agreement that H.R. 2156 must be passed and  become law.

Organizations in Support of H.R. 2156- “Jason’s Law”

  • OOIDA Owner-Operator Independent Drivers Association
  • ATA American Trucking Association
  • Teamsters The International Brotherhood of Teamsters

It’s time to for us all to be determined and not depend on the next guy.  Here is an article written by Todd Dills of OverDrive Magazine which explains why we must not be passive,  but instead, the  absolute vital importance of why we must all be  proactive in this cause.   We must all create a frame of mind within ourselves that says,

” If I make this call today, Jasons Law Will be passed”

Valuable Links

Hope Rivenburg has made numerous trips to Washington in support of HR 2156, attempting to gather support and co-sponsors for the bill.
She does this for 2 reasons:

  1. So that her husbands death will not be in vain
  2. So that no other truck driver or their family will have to endure  similar pain and loss

Hope will be a guest on a Blog Talk Radio Show on June 10th, 2010 at Noon  EST  “Jason’s Last Ride- The Truth About Trucking”

Remembering Trucker Jason Rivenburg

March 5th, 2010

Jason Rivenburg - Jason's LawFriday, March 5th, 2010 will  mark the one year anniversary of the death of fellow truck driver, Jason Rivenburg.  Killed by a gunman for a measly $7.00, Jason had pulled into an abandoned gas station to park his truck, due to the lack of parking in the area for commercial vehicles.  Leaving behind a wife and two year old son, Hope Rivenburg also gave birth to twins shortly after Jason’s death.  Although Jason Rivenburg was not the first professional truck driver to have their life taken away from them due to a lack of safe and secure parking areas, Hope Rivenburg set out on a mission to make certain no other driver would fall victim to such a meaningless crime.

With the support of so many, including New York Congressman Paul Tonko, they introduced a bill into legislation that would provide the safe parking areas that are needed by commercial truck drivers:  House Bill H. R. 2156 . . . Jason’s Law.   At present, the Jason’s Law Petition has received 9,188 signatures and the support of thirty three sponsors:

  • Rep. Jason Altmire   [D, PA-4]
  • Rep. Michael Arcuri   [D, NY-24]

Jason Rivenburg's FamilyJason’s Law is not only about Jason Rivenburg, but for all professional CMV drivers who have been endangered by the lack of safe parking for the big rigs.  From parking lots, rest areas, side streets and from on and off exit ramps, professional truckers are expected to do their jobs with little effort for safety precautions being established for them.

Finally, a bill specifically for truck drivers and their safety is at the forefront of the trucking industry.  Hope Rivenburg has fought long and hard for Jason’s Law even through a time of great loss and grief.   With so much support coming through for H. R. 2156, truckers can have the safe and secure parking they need to do their jobs and to make it back home to their families.

Continue to contact your Representative and voice your support for Jason’s Law.

Man Convicted of Jason Rivenburg's murder

Today in a Calhoun county Courtroom in South Carolina, suspect Willie Pelzer was found guilty for the murder of Jason Rivenburg whom he shot in the head on March 5, 2009.  It only took the jury a few hours to find Pelzer guilty of the murder. The defense team fought hard saying that there was no physical evidence linking his client to Rivenburg’s killing, however,  testimony by Pelzer’s childhood friends , girlfriend and many other witnesses, proved to aid in the quick deliberation of the guilty verdict. The surprise  though, was that when Pelzer  was being sentenced, he confessed to the shooting of Rivenburg.

Rivenburg’s widow, Hope Rivenburg, was in the courtroom for the entire trial, which began on  Tuesday Dec 1st, until the verdict on Friday Dec 4th.  Hope has been promoting and pushing hard for the passing of “Jasons Law” HR2156, a bill that was presented to the House of Representatives  by New York  Congressman Paul Tonko in April of this year. The Rivenburgs, who are residents of New York state, have worked closely with Rep Tonko since the murder of Jason.

Rivenburg Family

Hope’s passionate desire to encourage people to sign the petition for the bill has been ongoing for months now. She shared her tragic story with hundreds of truckers in Dallas ,Texas this last August  at The Great American Show.  Hope was there with her 3 children of 2 and under, as she presented pictures, brochures, pamphlets, flyers, and the petition for Jason’s Law. Hope’s booth was set up behind our booth ( TruckerApp) and I will tell you that I saw more than one driver with a teary eye when he/she walked away from her booth.  Most of the drivers had not even known of the murder and were touched by listening to the tragic story.

The bill HR 2156 will ensure safe truck parking for drivers. Parking has been a concern for truckers for many many years, but has somehow always been side stepped when it came to actually doing something about the problem.

“Jason’s Law” would create a six year pilot program that would make $120 million available in from of grants ($20 million per year) for local governments and private companies to address the shortage of parking for commercial vehicles on the National Highway System.

If you have not signed the petition for the passing of “Jason’s law”, we ask that you do it now.  We also have a video which will further explain the tremendous  need for this bill to be passed into law.

Many thanks to Hope Rivenburg for her strength, courage,  perseverance, and the determination to ensure that no other family will have to suffer through a similar tragedy such as hers.   Please sign the petition so that HR2156 will be put into law and Jason Rivenburg’s death will not be in vain.

Jason's Law BoothThe drive for secure and safe parking areas for our professional truck drivers was on display at the recent Great American Trucking Show and its popularity and recognition was well noticed.  Hope Rivenburg and family members were set up at booth #23149 and the voice of Jason Rivenburg was heard loud and clear. Advocating for Jason’s Law, hundreds of trucking enthusiasts and drivers learned, for many the first time, about Jason’s Law H. R. 2156, which is a bill seeking to pass a law to address the ongoing and escalating problems with truck driver safety and security.

With thousands of attendees enjoying the three day event, the Jason’s Law Booth even caught the attention of GATS as a featured article of the event:

Jason's Law at GATS 2009

Hundreds of new signatures were received for the Jason’s Law petition and new awareness for the cause was escalated.  Donna finally got to meet Hope Rivenburg and the twins: Logan and Hezekiah.

It was quite apparent that the Rivenburg family is on a mission to bring about safe and secure truck parking, being joined by literally thousands of supporters for the cause, and the 2009 GATS show did just that.  It was a lot of work and effort and I would like to thank Hope and her family for all their effort it took to get to Dallas for the show:  Hope with Josh and the twins:

A lot of work and determination, but also some fun and enjoyment as well.  Little Josh Rivenburg even got to meet TruckinDog Karma and her owner Trucker Desiree:

YOU Did It! Jason’s Law is Going to GATS

Safe Truck Parking - Jason's LawBecause of YOUR support and dedication to the cause, Jason’s Law will be attending the Great American Trucking Show in Dallas, Texas.   Your donation(s) have insured that Hope Rivenburg and family members will have the opportunity to keep this important issue out in the open, and to continue forward in achieving the final goal:  to pass H.R. 2156 into law.

We can never take anything for granted, especially those decisions which ultimately come from within the Washington beltway.  We must continue to push forward and let our voices be heard through various means:  blog posts, emails, letters, phone calls . . . even if we believe that Jason’s Law will pass with flying colors, we can never assume that it is a “done deal.”  We need to continue on by never allowing our support to grow quiet just because we think “that it’s going to pass anyway.”

With Jason’s Law now headed to GATS, this is only one aspect of the two part goal.   Now, let’s keep working to insure . . . to be certain . . . that Jason’s Law will, in fact, become law.  Safe and secure parking areas for our nation’s truck drivers will certainly add to the equation of preventing such tragedies from happening to another driver and family.  Even if it is just one driver, that would be one life saved, one family spared.

Thanks to all of you who donated to the Jason’s Law GATS cause.  As trucking companies and organizations chose not to donate, truck drivers and non-truckers alike, came together and showed that even a “small group” of people can make a difference.  We are ecstatic about the large anonymous donations that came in the weekend of the 25th.  Your generous donations are now over $2,800.00, plus the GATS booth which is valued at $1200, donated by gotruckstop.com.   The Rivenburgs are going to Dallas!

Be it one dollar or five hundred dollars, your donation is the reason that H.R. 2156 will have a place at the Great American Trucking Show.  There is no purpose in showing “who” donated, because they did not do it for recognition . . . they did not allow ego’s to stand in the way for supporting a worthy cause.  It was done for the simple fact alone, that Jason’s Law is an important and vital bill that needs to be passed to insure safe and secure parking for the millions of professional truck drivers who keep America moving every day.

H.R. 2156 will be at GATS, thanks to all of you.  YOU did it.

Let’s keep pushing forward . . . keep working to bring H.R. 2156 into law.  Do not “assume” that the goal has been accomplished.  It reminds me of a saying that an instructor always told me:

“Never claim victory, until the battle has been won.”

Because of YOU, Jason’s Law will seek further support at GATS . . . keep sounding your voices . . . keep signing the petition.

Thanks to all for your help in this cause,

Allen Smith

Will Hope Rivenburg and Family be at GATS? With a little help from…….. OOIDA or the ATA

The families of Murdered Truck Driver Jason Rivenburg are continuing their campaign for “Jason’s Law”, H.R.2156, which will implement a pilot program to address shortages in safe parking for commercial motor vehicles on our National Highway System.   It is necessary that we continue to collect as many signatures on the petition as possible in order to ensure the passing of the bill.  Jason’s Law will create the 6 year Pilot Program  in the amount of 120 million dollars in grants over a 5 year period. The legislation allows the Secretary of Transportation, in cooperation with appropriate State, regional, and local governments, to allocate funds to improve rest areas that serve the National Highway System.

Whenever I speak to Hope Rivenburg ( Jason’s Widow), gratitude just pours out of her. It’s quite humbling to speak to someone who has gone through so much, and yet so much of her words are in appreciation of others.  She appreciates all the websites and blogs who have helped in the support of “Jason’s Law”, no matter how small or large they are,  all the individuals who have expressed their most sincere condolences, and everyone who has signed the petition.

Along with the many individuals, trucking blogs and websites such as this one, there are 2 major organizations who are supporting   Jason’s Law… OOIDA and The ATA.

During my conversations with Hope,  she has expressed that she is also very grateful for the support of both The ATA and OOIDA .  She said that OOIDA wished her the very best in all her endeavors when she had  first  contacted them about the proposed bill .  Hope said that  it wasn’t too long after though, when Congressman Paul Tonko (D-NY) released the draft of the bill  “Jason’s Law” or H.R. 2156,  they  came to bat and  supported  the family and the bill through magazine postings and calls to action.

Hope and her family initially met with Congressman Tonko on March 14th, 2 days after Jason’s funeral, in a coffee shop in New York State, to discuss the need of the bill. Since that first meeting,  Hope  and her family members have worked tirelessly in order to make sure that this Law passes and that another family does not have to endure the same kind of tragedy or loss.   You can read the family Journal which gives an account of the struggles and progress which they share on their Blog

On April 28th Congressman Paul Tonko introduced legislation H.R. 2156 in the House titled “Jason’s Law,” which would implement the pilot program to address shortages in safe parking.  I think Paul Tonko’s name is engraved on the hearts of Jason Rivenburgs family, as well as many others who are grateful for his initiative in introducing “Jason’s Law.”

OOIDA Executive Vice President Todd Spencer said Tonko’s bill is a “good one” and urges members to call their representatives and educate them about how this bill will help provide safe parking for truckers.  “We need to pursue whatever is possible to expand the amount of parking in areas where it’s so desperately needed,” he said. Read the entire post here.

Shortly after, the ATA quickly jumped on board and strongly supported HR 2156 and S971. In an article posted  May of  this year in FleetOwner Magazine, “Jason’s Law: ATA pushes for quick passage of truck-parking measure”  President and CEO Bill Graves stated,  “The parking shortage for commercial motor vehicles comprises the safety of drivers out on the road and requires a comprehensive solution involving all interested parties.”

This is a time when it is necessary that we all stand together ( as we are).  Drivers, Trucking Blogs and Websites,  OOIDA, the ATA and everyone else who is concerned about the safety of drivers’ lives out on the road and the desire to see” Jason’s Law” a reality( not a dream) are in unison together.

This August The Rivenburg and Hardendorf family members are hoping to attend The Great American Trucking Show ( GATS) in Dallas, TX.  It is their desire so set up a booth and run their campaign, to reach so many thousands more about “Jason’s Law”, providing their many pamphlets, T-shirts, bracelets, etc….educating people about the  crucial need and vital importance of this legislation.

As you can imagine, cost of the trip for the family members and the added cost of a booth at GATS, can be quite expensive.

I asked Hope Rivenburg if she would accept sponsorship from either The ATA or OOIDA for their campaign at GATS.  She was thrilled and deeply moved at the thought of a sponsorship.

It is at this time we would like to make our plea for Sponsorship to both the ATA and OOIDA for the Rivenburg and Hardendorf family members. Please reach out and help them, as they have endured so much, and yet remain dedicated and loyal to the cause of  their passing loved one and his fellow brother and sister truck drivers. We know how important this bill is to you, imagine how much more important it is to Jason’s family.  Their presence at GATS will surely impress  and imprint the hearts of thousands more.

ATA and OOIDA:   Please contact Hope Rivenburg for your sponsorship.  God Bless You
email at :   h_rivenburg@jhlrivenburg.com

We thank you all for all that you have done, continue to do, and will do, in order to ensure that “Jason’s Law” becomes a reality and that Jason Rivenburg’s death was not in vain.

Special thanks for my friends who inspire me to be a better person and to  fight for the rights and betterment of others:
