Stop False DAC Reports Petition Nearing 1,000 Signatures

Will more professional truck drivers continue to come together and work to end the false reporting by trucking companies against drivers DAC reports?  Our Stop False DAC Reporting petition is nearing 1,000 signatures, but many more are needed in order to show a strong and viable case against this segment of corruption in the trucking industry.  This petition is one reason, I believe, that USIS removed itself from DAC Services, and was taken up by HireRight DAC Trucking Solutions.

Previous false information placed on a driver’s DAC report by the former USIS/DAC Services, could even be more difficult to have removed because now, HireRight can simply say that they are not the company who placed such information on the report . . . that it was done by USIS/DAC, which is no longer associated with the services.   An interesting move as the DAC Petition grows in support?   Furthermore, the complaints by drivers continue:

  • DAC has completely ruined my Driving career. My DOT/MVR/DMV record mean nothing! to anyone in Trucking. Compared to the lying slander of this reporting agency! My understanding is of the companies that use this agency (of which is 90% of them) when checking a Drivers back ground Dac is the first check. They look” No further…if there is something Negative there, that’s it! No one compares it to local/state/federal records. Or even ask or listen to the Driver who’s career/livelihood is on the line! Nowhere” in America, is this allowed! Slander/defamation/predigest should never” be tolerated! however; this Dac agency seems to be a exception to the rule! They destroy lives, and could care less! Trucking companies use this agency to pay back Drivers that won’t put up with theie abuse! when you quit” a company…they pay you back” through this Dac reporting agency.
  • I’m a victim of this, after almost 11 yrs of driving got blacked balled by 2 companies and now with disconnection notices and an eviction notice I’m unable to get a driving job, a father of 2 young kids my life is ruined, now at 45yrs of aged I’m suppose to start over again, thanks U S Government, thanks for the American dream.
  • I agree.   I am a victim of dac reports.  I’ve been a driver for 10 years nowand it’s impossible to get dac to do anything for the drivers.  They gave me a real hard time getting copies, they also had a false report from a company that I had left years ago. The only thing I was allowed to do is write a statement, but most companies are going to believe the company over a driver.  I want to end Dac.
  • I hope something can be done.  I’ve been out work for two years now,because no trucking company would hire me. I have some false report on my DAC, and trying get information on how can I get this fixed.  It is a shame how companies  don’t care.  I  am a good driver,  never had a accident, and pretty sure there are drivers out there like me that are having the same frustration not able to get a decent job as a professional driver.  I just hope something can be done soon.  I would give all my support and help to fight this abuse against my fellow drivers.  I am here to sign this petition and take action to try to help fix this problem we are having.  You have all my support, and God bless you.

How a Truck Driving School Can Ruin Your Driving Career

There are those truck driving training schools that will use one technique that will insure a new drivers’ failure at a driving career every time:

Another email from a CDL graduate with the same story:

“Just because my teacher at XXXX Training School told me not to put my DUI on my application because the DUI was over 5 years old, they fired me because I did not put it down.  I was out on the road with my trainer for a week and they red flagged me and then fired me.  I can’t seem to get any trucking company to even look at me now.”

When I receive emails like this one, and I get a lot of them, it simply makes my blood boil.  As author of the first and original, Truth About Trucking, I want to reiterate the TRUTH about what some truck driving schools will do that will end your truck driving career before it even has a chance to begin.  It’s not like I haven’t already made this SCAM known, but it’s time to let it be known again.

It is true that trucking companies will normally do a back-ground check for the past 5-7 years.  The above email was sent to me by a new driver that had experienced a DUI back in 1996.  So, here’s the truth AGAIN:

The trucking company means absolutely NOTHING when it comes to the completed hiring process.  The ultimate decision will nearly always come from the insurance carrier.   The employment application will always ask the question in similar form such as, Have you ever been….?” or “Have you ever had a…?” or “Have you ever been convicted of…?” and so forth.  The key word here is:  “EVER“.

If the question is, “Have you ever been convicted of a DUI?” -  then it means “ever.”  Even if the DUI was 75 years ago, ever means ever.  By not putting it down on the application constitutes “falsifying a Commercial Motor Vehicle Application” which is a very serious offense.   State and Federal Laws are very clear about this matter:

“Any person who falsifies any information in an application or test for a commercial driver’s license shall not be licensed to operate a commercial motor vehicle, or the person’s commercial driver’s license shall be canceled, for a period of one year after the director discovers such falsification.”

These truck driving school instructors, recruiters and driver trainers know this.  By telling you not to write it down on the application because they only go back several years, is nothing but a lie and a scam.  The school still keeps your money and you could very well be in a situation where you may never find work as a truck driver.  At the minimum, you will be out of luck for at least one year.  Then, after one year has passed, you will be required to go through CDL training all over again, and yes, you will have to pay for it once more.

Because you may have driven for one or two weeks before the insurance carrier caught it, the trucking company will then turn around and place a “falsifying” report on your DAC.   All future employers will see this report and thus, the reason for not accepting you within a driving position.  Also, the HireRight DAC Trucking Solutions, who oversees the DAC report, could care less about the truth.  You have the right to place your side of the story on your DAC and try to have it removed through the use of an attorney, but this can be very time consuming and costly.

REMEMBER:  When a recruiter or truck driving school official or driver trainer tells you not to worry about writing down a violation that occurred over 5-7 years ago … they are either lying or they are just ignorant.  It is a SCAM!

Doing so, will end your driving career and landing another truck driving job could take a very long time.

ALWAYS list EVERYTHING down on the Commercial Motor Vehicle Application no matter what the offense and no matter how long ago it was.

Trucking DAC Report

Truth About Trucking is setting out to bring about changes on how the DAC agency, USIS,  operates when it comes to the false reporting by trucking companies on their drivers.  As professional drivers, we all know that many of these reports on the DAC are false and are done so, only through a revengeful attitude by a company’s employee.  This is no secret.  Truth About Trucking, LLC is preparing a report to submit to Congress requesting that actions be taken against these falsifying claims and the proper rights are given to drivers in order that they can have these falsifications corrected or removed from their DAC reports.

Why Isn’t My Current Employer on my USIS/DAC Report?

This is a good post I found from an excellent website ….

One of the more common questions I receive concerns why a current employer does not show up on a USIS “DAC” report. A driver will call me, has received his DAC report, is currently working for a carrier trying to build a good record.and the experience doesn’t even show up. They’ve worked hard, been accident free, done a great job and are displeased that this employment is missing on the report. Typically, the question (and answer) go something like this:Question: I have been working for John Doe Motor Carrier for two full years. In that time, I have driven 48 states, been drug tested multiple times and driven hundreds of thousands of miles. In fact, I am still working for them.
I know that this company is a member of USIS/DAC and reports employment history on drivers-and yet, I obtained my report and this company does not show up. I am looking for a new job and am concerned that this employment not showing will goof me up. Is this a mistake or is someone hiding something?

Answer: The reason the employment does not show up is because it has not yet been reported by your current employer. It has not been reported by your current employer because your employment history for a particular period of service with a company is not complete until your employment terminates with that employer. When your employment terminates, the employer evaluates your whole period of service and then reports to USIS on the standard employment history report.

But not to worry-in fact, looking for a job while you are still employed offers many advantages. One of the advantages is that a potential employer-seeing that you are still employed-may reason that you are a good employee/driver because if you weren’t, you would have been terminated by the employer.

Therefore, the process may work like this. Your potential employer will check your background previous to your current employment. If your prior record looks good and the potential employer’s offering looks good to you, the employer will request permission to check with your current employer and potentially make a conditional job offer contingent on acceptable experience with this company and passage of their normal pre-employment drug/driving and orientation requirements. And so, the two years of employment do matter and the employment will be checked by prospective employers.

In fact, if you do cease employment with the previous carrier and begin working for the new company, the previous carrier (assuming they are reporting members of USIS) will report your employment history to USIS-usually within a month of termination of employment. While employed with your new carrier you may recheck your DAC report to see what your former employer reported.
